Terms of Use

These Terms of Use are an agreement between you and Jeff Ai HQ LLC, an Ohio limited liability company ("we", "us"). They cover the Memento Mane iPhone app ("the app").

By installing or using the app, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the app.

You must be 13 or older to use Memento Mane. If you are under 18, you need a parent or guardian's permission.

Memento Mane rings a morning alarm and, for a time you choose, pauses the apps and websites you pick, showing a quote instead. It is a tool to help you build a habit. It is not medical or mental-health treatment. The quotes are for reflection only, not professional, medical, legal or financial advice.

• Only the apps you pick are paused. Phone calls, messages, emergency features and every app you did not pick keep working.
• You can always get in. Tapping "I really need it" unlocks the app you tapped for 5 minutes. If you picked a whole category of apps, that whole category unlocks for 5 minutes. For anything longer, such as a video call or a court hearing, you can end that morning's Hora Prima in the app at any time; your apps then stay open for the rest of the morning. You can also turn off Memento Mane's access in your iPhone's Settings (Screen Time → Apps with Screen Time Access), which lifts every pause straight away.
• The pausing is done by Apple's Screen Time and the alarm by the iPhone's own alarm system. They depend on your iPhone's settings, battery and iOS version, and Apple can change how they work.

You choose which apps and websites are paused, and you are responsible for that choice.

• Never pause an app you need for your health or safety, such as a medical device, glucose monitoring, medication, medical alert or emergency app.
• Think before pausing apps you may need at short notice in the morning, such as messaging, work, video calling, banking or sign-in code (two-factor) apps. While an app is paused you may not see what happens in it until you open it.

Do not use Memento Mane as your only alarm for anything important, such as work, travel, medication or appointments. An alarm can fail to ring if your iPhone is off, out of battery, damaged, set to silence alarms, or if iOS changes or misbehaves. Set a second alarm when it matters, for a different minute: when two alarms ring in the same minute, iOS can silence both.

• Free week. Starting the free week is a free (0.00) purchase through Apple. It gives you every feature for 7 days from that moment. Each Apple ID can start the free week once.
• One-time unlock. After the free week, you can keep Memento Mane with a single purchase at the price shown in the app and the App Store. It is not a subscription and never renews. You will not be charged unless you choose to buy it.
• If you don't unlock when the free week ends, the alarm and the pausing stop. Nothing is charged, and your settings stay on your iPhone in case you unlock later.
• Payment is handled by Apple under its terms. The price is the one shown at the time you buy, and we may change it for future purchases.
• Refunds. All purchases are final, except where the law says otherwise. Refund requests are handled by Apple under its refund policies. We cannot issue App Store refunds ourselves.
• Your unlock follows your Apple ID. On a new iPhone or after reinstalling, tap Restore purchase to get it back.

You agree not to copy, reverse engineer, resell or interfere with the app, or use it for anything illegal.

The app, its name, design, text and code belong to Jeff Ai HQ LLC. These terms give you permission to use the app for your own personal, non-commercial use. They do not give you any ownership of it.

The quotes in the app come from translations that are in the public domain (George Long's translations of Marcus Aurelius and Epictetus, and Aubrey Stewart's translation of Seneca), lightly modernised by us.

If you send us ideas or feedback, we may use them freely without owing you anything.

We may change, pause or stop offering the app or any part of it at any time. Updates to iOS may change how Screen Time and alarms behave, and the app may not work as described until we update it.

The app is provided "as is" and "as available". To the fullest extent the law allows, we make no promises about it, express or implied. That includes any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

We do not promise that the app will always work or be free of errors, that the alarm will always ring, or that apps will always be paused or unpaused at exactly the right time.

To the fullest extent the law allows:

• We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data or lost profits.
• We are not liable for anything you miss or cannot do in an app or website you chose to pause, including messages, calls, notifications, sign-in codes, payments and transactions.
• We are not liable for oversleeping, missed or late appointments, work, travel or medication, or anything else that results from an alarm that did not ring or rang at the wrong time, or from an app being paused or not paused.
• Our total liability to you for everything connected to the app is limited to the greater of the amount you paid us in the 12 months before the claim, or 50 US dollars.

Some places do not allow some of these limits, so parts of this section may not apply to you.

If someone brings a claim against us because you broke these terms or misused the app, you agree to cover our reasonable costs and losses from that claim, including legal fees, as far as the law allows.

Ohio law governs these terms, without regard to its conflict-of-law rules. Any dispute that we cannot settle informally will be heard in the state or federal courts located in Trumbull County, Ohio, and you and we agree to those courts.

You got the app from Apple's App Store, so Apple's terms apply to you as well.

• These terms are between you and Jeff Ai HQ LLC, not Apple. We, not Apple, are responsible for the app and its content.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to meet a warranty that the law does not let us exclude, you may notify Apple for a refund of any purchase price paid through it. Apple has no other warranty obligation for the app.
• Apple is not responsible for claims about the app, including product liability, legal compliance or intellectual property claims.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
• You confirm that you are not in a country under a US government embargo and are not on a US government list of prohibited or restricted parties.

• Changes to these terms. We may update these terms. We will change the date at the top of this page and, for significant changes, tell you in the app. Continuing to use the app after a change means you accept it.
• If part of these terms cannot be enforced, the rest still applies.
• If we do not enforce a term right away, we have not given it up.
• Whole agreement. These terms and the Privacy Policy are the whole agreement between you and us about the app.
